Terms and Conditions of Sale

D-Day Audio Guide – Southwoods Digital

Last updated: September 2026

Article 1 – Purpose and scope

These Terms and Conditions of Sale (“Terms”) govern purchases made on ddayaudioguide.com for access to the D-Day Audio Guide digital service, a mobile self-guided audio tour of Normandy’s landing beaches, battlefields, cemeteries, monuments and other historic sites. The app uses device GPS location to offer or trigger some audio content.

These Terms apply to website purchases. Purchases through the Apple App Store or Google Play are also subject to the relevant platform terms. Placing a website order constitutes acceptance of these Terms.

The service is sold by:

Article 3 – Service description

The service is accessed through a compatible iOS or Android app and may include audio narratives, historical information, geolocated points, GPS features, travel directions, photographs, illustrations and maps.

Internet access is required for installation, code activation, initial downloads and some external navigation services. Core downloaded content can be used offline, but external services may still require Internet access. The customer is responsible for device compatibility and operation, location settings and any required connection.

Article 4 – Plans, users and access period

Each plan’s permitted users or devices and price are shown before checkout. Website “Holiday Pass” plans provide access for seven (7) consecutive days beginning when the code is first entered and activated in the app, not on the purchase date.

For multi-user or multi-device plans, that first activation starts the same 7-day period for everyone. Later activations neither restart nor extend it. Codes may only be used by the customer and people included in the purchased plan and may not be resold, published, shared outside the group or used beyond the activation limit.

Article 5 – Prices

Prices are those displayed at checkout, in euros (€), including applicable taxes under the seller’s tax regime. The total is shown before final confirmation. Price changes do not affect paid and confirmed orders. App Store and Google Play prices may differ.

Article 6 – Orders and payment

The customer reviews the plan, total price and essential features before payment. Website payments are securely processed by Stripe; D-Day Audio Guide does not retain complete card details. An order is final after payment confirmation, which is emailed to the address supplied. The customer is responsible for providing accurate information.

Article 7 – Delivery and activation

After payment, the customer receives access information including an activation code, then downloads the app from the Apple App Store or Google Play and follows its activation and download instructions. The initial download requires a stable connection and should be completed before the visit.

For activation or download difficulty, contact support@ddayaudioguide.com before deleting the app or buying again.

Article 8 – Withdrawal and immediate digital supply

Under the French Consumer Code, a consumer normally has fourteen (14) days to withdraw from a distance contract. However, as provided by law, withdrawal may not be exercised for digital content not supplied on a tangible medium once performance begins before that period ends, following the consumer’s prior express consent and acknowledgement that the right will be lost.

Immediate access therefore requires that express consent and acknowledgement before checkout. Where the legal conditions are not met, the customer retains applicable rights. Rights concerning non-conforming digital content or services remain unaffected.

Article 9 – Technical support

D-Day Audio Guide endeavours to keep the service available and working. Customers may report activation, download or use problems to support@ddayaudioguide.com and may be asked for an order number, device and operating-system details and a problem description. An appropriate solution will be offered where the issue concerns the service, in accordance with consumer law.

Article 10 – Statutory conformity guarantee

Consumers benefit from the statutory conformity guarantee for digital content and services. The seller is responsible for conformity and defects under the conditions and periods set by law. Remedies include bringing the service into conformity and, where legally available, a price reduction or termination. These rights apply independently of any commercial warranty.

Article 11 – GPS use and safety

The app is designed for visits by car and on foot. GPS accuracy and availability vary by device, environment and third-party services. Drivers must obey traffic and safety rules and must not handle a mobile device while driving. Screen interaction must occur only when safely and legally parked. App directions do not replace road signs, authorities’ instructions or driver judgment.

Article 12 – Site access and visitor information

Opening hours, access, prices, works, closures, traffic restrictions, weather and other circumstances may change independently of D-Day Audio Guide. Customers should verify important information with each site. Access cannot be guaranteed where it depends on third parties, public authorities or circumstances outside reasonable control.

Article 13 – Liability

D-Day Audio Guide will provide the service under these Terms and applicable law. The seller is not liable for consequences of use contrary to these Terms, dangerous use while driving or events reasonably outside its control. Nothing excludes or limits consumers’ mandatory rights.

Article 14 – Intellectual property

Website and app text, scripts, audio, recordings, photographs, illustrations, graphics, maps, logos, databases and software are protected by intellectual-property law. Purchase grants only a personal, limited, non-exclusive and non-transferable right of private use for the plan’s duration. Unauthorised reproduction, extraction, recording, redistribution, resale or commercial use is prohibited.

Article 15 – Personal data

Order and service-use data is processed under applicable data-protection law. Details of data, purposes, retention, recipients and user rights appear in the Privacy Policy.

Article 16 – Complaints

Article 17 – Governing law and disputes

These Terms are governed by French law. Customers living elsewhere retain any mandatory consumer protections under applicable law. Customers should first contact D-Day Audio Guide to seek an amicable solution; otherwise they may bring proceedings before the competent courts under applicable rules.

Article 18 – Changes to these Terms
